The Resort at Pedregal (hereinafter referred to as the "Resort" or “We”) is operated by Hoteles del Cabo S de RL de CV, who controls the processing of the personal information that you provide to the Resort while visiting Resort website, namely, (hereinafter all identified URLs are collectively referred to as the "Site").

At the Resort the privacy and confidentiality of user personal information (as such term is defined below) is important. We are committed to maintaining the privacy and security of your user information. We may update this policy from time to time, so please check here frequently so that you, the user and data subject, is properly informed of our privacy standards. Other than as described in this Privacy Policy, Resort will not disclose identifiable user information to any third party without obtaining your additional consent.

Resort is committed to safeguarding your privacy while visiting the Site. Our goal is to provide you with an Internet experience that delivers the information, resources and services that are most relevant to you. To achieve this goal, part of the operation of the Site includes the gathering of information about Site users.

What information is collected about you?

Because we understand that your privacy is important, we wish to explain the types of information we gather and the way in which we use it.

This Privacy Policy covers two types of information gathered by the Resort through different means: personal information and non-personal information. The term "Personal Information" refers to any information relating to an identified or identifiable natural person that you voluntarily provide in connection with the Resort services or the use of the Site. Personal Information that we obtain includes your name, e-mail address, phone number, company affiliation, physical address, birthdate, nationality, signature, tax identification number, population registry number, marital status, photo identification, hired services and credit card number.

The term "Non-Personal Information" refers to other information we collect about your activity on the Site. Although this information may be about you in a general sense, it does not, in itself, identify you.  Examples of Non-Personal Information include information provided by your browser and collected via cookies. We use Non-Personal Information in the aggregate to learn about traffic patterns, number of visits to certain pages, visits from other web sites or to third-party web sites linked to the Site, use of particular services and interest in services, information or features of the Site or other parties made available through or found at the Site.

How do we use it?

We take the utmost care to ensure that the Personal Information we obtain from you is not used in a way that you may be unaware of or not agreeable to. Generally, when we ask you for your Personal Information we will only use it for the purposes specified at the bottom of the information gathering form or for the purposes specified in this Privacy Policy

The Personal Information collected by the Resort will be used for the following originating purposes:

  • Register you as a Resort member, guest and/or visitor.
  • Plan and purchase Resort accommodations.
  • Identify you and provide to you access to the Resort’s premises.
  • Provide accommodation, touristic and commercial services.
  • Ensure the functionality and quality of Resort’s services in order to provide personalized attention, safety and, when required, hiring or confirmation of third-party services requested by you.
  • Create statistical and historical records of users.
  • Invoice and collect bills for the Resort’s services.
  • Communicate with you regarding the services provided by the Resort.

The Personal Information will be also used for the following additional purposes:

  • Enter you in our promotions or sweepstakes.
  • Send marketing communications or surveys to you.
  • Respond to your questions or suggestions.
  • Improve the quality of your visit to our Site.
  • Security, credit, or fraud prevention purposes.
  • Understand your needs and interests.
  • Improve our products and services.
  • Improve our marketing and promotional efforts.

All forms in the Site will provide an opt-out button to allow you to choose not to participate in Resort lists and future online marketing. In deciding whether or not to join such lists, please note that they are only used for Resort purposes or in joint promotions with a Resort partner. You may request to be removed from our lists at any time. All emails distributed to our lists will contain easy, online access to unsubscribe.

Sharing your Personal Information

Except as explained below, we do not sell or rent any of your Personal Information to any third party, including any third-party joint promoters, for their own marketing purposes.

Resort may share your Personal Information with third-party vendors who act for us or on our behalf. For example, we may share your email address with Trip Advisor LLC, in order to assess the quality of our services. These vendors are prohibited from using your Personal Information for any purpose other than performing their contractual obligations to Resort.

We may share your Personal Information with other third parties, at your request, for the sole purpose of providing third-party products or services that you have requested. We may also share your Personal Information with Resort’s affiliates, subsidiaries, or controlling entities, under our control and with the same processes, internal policies and security measures.

We may also share your Personal Information with a successor organization if, for example, we transfer the ownership or operation of the Site to another organization or if we merge with another organization. If such a transfer occurs, the successor organization’s use of your information will still be subject to this Privacy Policy.

Finally, we may share your Personal Information when we, in good faith, believe disclosure is appropriate to comply with the law, a court order or a subpoena. We may also disclose your information to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of this Site; to enforce or apply our online Terms of Use [insert link] or other agreements; or to protect our own rights or property or the rights, property or safety of our users or others.

If you do not expressly disagree to these transfer of your Personal Information, we will assume that you have consented such transfer.

Permission for Use

Resort may collect and use Personal Information that you submit in any manner that is consistent with this Privacy Policy or that is disclosed elsewhere at the Site or the Resort premises, at the point you submit such Personal Information. At the time you submit Personal Information or make a request, the intended use of the information you submit will be apparent due to the context in which you submit it and/or because the Site states the intended purpose. By submitting Personal Information to the Resort, you are giving your consent and permission for any use that is consistent with uses stated in this Privacy Policy or disclosed elsewhere at the Site or at the point you submit such Personal Information, and such consent will be presumed by Resort, unless you state otherwise at the time you submit the Personal Information or unless the applicable law request written and/or express consent. Please do not request any such communications on behalf of an individual or company if you are not authorized to make the request.

Secure Reservations

If you decide to make an online reservation at the Site, you will be linked to a reservation interface and a third-party booking engine (“Booking Engine”) provided by Synxis. While it appears to be part of our Site, the Booking Engine is in fact provided by a third party and is governed by its own privacy policy and practices. We understand that security remains the primary concern of online consumers and have chosen the Booking Engine Vendor carefully.

Protecting your Information

We would like our Site visitors to feel confident about using the Site to plan and purchase their accommodations, so Resort is committed to protecting the information we collect.

Our Site is hosted in a secure environment. The Site servers/systems are configured with data encryption, or scrambling technologies, and industry-standard firewalls. When you enter Personal Information during the reservation process, or during a customer email sign-up, your data is protected by Secure Socket Layer (SSL) technology to ensure safe transmission.

However, we cannot guarantee the security of information provided over the Internet or stored in our databases and will not be responsible for breaches of security beyond our reasonable control.

How to Revoke the Consent to Use Your Personal Information or Exercise Your ARCO Rights

You may have the right under applicable law to access your Personal Information in our possession; rectify your Personal Information if incorrect or incomplete; request deletion of your Personal Information when you consider it no longer required for the purpose for which it was collected, or if it is being used for an unconsented purpose, or if the legal relationship is over; and to oppose the processing of your Personal Information for specific purposes. These rights of access, rectification, cancellation and opposition are hereinafter referred as “ARCO” rights.

You also have the right to revoke the consent that you have granted to us for the processing of your Personal Information.

You may exercise your ARCO and revocation rights at any time, by sending a written request to or to our “Committee of Personal Information”. The petition shall be made by means of any applicable form and shall include, at least the following information: (a) name, signature and address or any other contact information necessary to notify you of the response to your request; (b) identity or legal representation, if applicable; (c) precise description of the Personal Information for which you wish to exercise any of your ARCO rights, and (d) any other information tending to facilitate identifying your Personal Information.

The Resort will respond to your petition as required by applicable law, and may do so by e-mail. Depending on applicable law, the Resort may have the obligation to respond to your request within 20 (twenty) business days after receiving your request. Once such period has elapsed and the Resort has failed to respond to your petition, applicable law may entitle you to file for the right’s protection procedure before the Federal Institute for Access to Public Information and Data Protection (Instituto Federal de Acceso a la Información y Protección de Datos).

Use of Aggregated Data

Resort is interested in improving the Site and may develop and offer new features and services. We monitor and aggregate Non-Personal Information regarding use of the Site for marketing purposes and to study, improve and promote use of the Site. In connection with such purposes, Resort may share aggregated data with third parties. Disclosure of aggregated data does not include Personal Information about individual Site users in any way that identifies who they are or how to contact them.

Use of Cookies

To enable features at the Site, Resort may assign one or more "cookies" to your Internet browser. Cookies, among other things, speed navigation through our Site, keep track of information so that you do not have to re-enter it each time you visit our Site, and may provide you with customized content. A cookie is an Internet mechanism composed of a small text file containing a unique identification number that permits a web server to send small pieces of information or text by means of your browser and place them on your computer's hard drive for storage. This text lets the web server know if you have previously visited the web page. Cookies by themselves cannot be used to find out the identity of any user.

We use this data only as explained in this Privacy Policy. We do not connect this data to any name, address, or other Personal Information.

You may occasionally receive cookies from unaffiliated companies or organizations, to the extent they place advertising on our Site or are linked to the Site. These third-party cookies may collect information about you when you "click" on their advertising or content or link. This practice is standard in the Internet industry. Because of the way in which the Internet operates, we cannot control collection of this information by these third parties, and these cookies are not subject to this Privacy Policy.

Children's Privacy & Parental Consent

Please be aware that Resort has not designed this Site for, and does not intend for it to be used by, anyone under age 18. Resort specifically requests that persons under the age of 18 not use this Site or submit or post information to the Site.

Drone Policy

Out of safety concerns for guests, employees, and resort property, as well as concerns for individual privacy, The Resort at Pedregal prohibits the operation or use of unmanned aerial systems, or drones, by the general public – including recreational users and hobbyists – without the prior written authorization from the Resort. This prohibition includes drones used for filming or videotaping, as well as any drone use by media or journalists operating above or within The Resort at Pedregal boundaries.

This prohibition on drone operations or use extends to any drones launched or operated from Resort property, as well as drones launched from private property outside of the Resort boundaries. Links Provided To Other Sites

Resort may provide links to a number of other web sites that we believe might offer you useful information and services. However, those sites may not follow the same privacy policies as Resort. Therefore, we are not responsible for the privacy policies or the actions of any third parties, including without limitation, any web site owners whose sites may be reached through our Site, nor can we control the activities of those web sites. We urge you to contact the relevant parties controlling these sites or accessing their on-line policies for the relevant information about their data collection practices before submitting any Personal Information or other sensitive data.

Your Consent To This Privacy Policy

Use of the Site signifies your consent, as well as the consent of the company for whom you use the Site and whose information you submit (if any), to this Privacy Policy, including the collection and use of information by Resort, as described in this statement, and also signifies agreement to the terms of use for the Site. Continued access and use of the Site relieves Resort from responsibility to the user thereto.

Policy Modifications

Resort reserves the right to change this Privacy Policy at any time; notice of changes will be published on our Site or Resort premises. Changes will always be prospective, not retroactive. If you have questions about our policies, please contact our Personal Information Committee.
